In the Military Cassation Court
The function of the commissioner before the court is handled by the cassation prosecutor who can mandate one of his assistant for this purpose and to authorize his competences to him before the military court.
In the Permanent Military Court
The law of Military Judiciary stipulates that the function of commissioner before the court will be handled by one of the judges of the eleventh grade and above (being equal to the sixth grade and above, according to the last amendments of the law of judicial judiciary) assisted by a judge or many judges, an officer or many officers among those graduate at law provided that his rank won’t be less than captain and above. The militaries among them will be mandated by the Ministry of National Defense for this purpose at the beginning of the year.
The commissioner before the Military Courts and his assistants shall be subject to the authority of the prosecutor before the cassation court and under his supervision and the headquarters of the commissioner shall be in the head offices of these courts.
